What this bill would do
The bill is known as the 5G UPGRADE Act of 2025. It amends the Middle Class Tax Relief and Job Creation Act of 2012 by setting a strict 60-day timeframe for State and local governments to review requests to modify existing wireless facilities. If a government fails to act within 60 days, the request is automatically deemed approved. The bill also establishes rules for pausing this 60-day timeframe if an initial or supplemental request is incomplete. Additionally, it prohibits governments from requiring pre-application processes and limits the documentation they can request. Finally, it allows requesting parties to enforce these provisions through expedited reviews in United States district courts.

Potential Positive Impacts for People
-
Section 2, Paragraph (4)(A) (Deemed approval): This provision sets a firm 60-day deadline for State and local governments to process wireless facility requests, which could benefit individuals and groups by speeding up the deployment and expansion of wireless and 5G networks.
-
Section 2, Paragraph (5)(B) (No pre-application requirements): This provision prevents State and local governments from forcing requesting parties to go through any process, meeting, or other step before a request can be considered submitted, which may reduce bureaucratic hurdles for getting projects reviewed.
-
Section 2, Paragraph (7) (Enforcement): This provision gives requesting parties the right to bring an action in a United States district court for an expedited review to enforce the bill's provisions, holding local and State governments accountable to the set timeframes.
Potential Negative Impacts for People
-
Section 2, Paragraph (4)(A) (Deemed approval): Because requests are automatically approved if the State or local government fails to act within 60 days, local communities and residents might lose their local voice or the ability to thoroughly review wireless facility modifications in their neighborhoods.
-
Section 2, Paragraph (6) (Limitation on required documentation): This provision restricts State and local governments from requiring documentation or information beyond what is reasonably related to determining if a request is an eligible facilities request, which could limit a local government's ability to gather comprehensive safety, environmental, or community-impact details from applicants.
