What this bill would do
This bill provides an emergency increase in Federal funding to State Medicaid programs specifically for home and community-based services during fiscal years 2026 and 2027. To get this funding, states must submit an application to the Secretary of Health and Human Services detailing their implementation plans and providing specific assurances. The provided funds must be used to supplement, and not replace, existing state funds spent on these services, and to boost worker reimbursement rates. States are required to work with community partners to focus on improving worker compensation, benefits, job stability, and service availability. Additionally, states must submit a final report by December 2029 detailing how the funds were used and how many individuals were served. Finally, the Secretary must arrange for an external evaluation of the program and share the findings publicly and with Congress.

Who it would affect, and how
Potential Positive Impacts for People
-
Increased Funding for Home and Community-Based Services: Under Section 2(a)(1), the Federal medical assistance percentage for participating states is increased by 10 percentage points for home and community-based services during fiscal years 2026 and 2027, which brings more federal dollars to support these programs.
-
Better Pay and Benefits for Workers: Under Section 2(d)(2)(A) and Section 2(d)(2)(B), funds can be used to increase reimbursement rates so agencies can increase worker compensation, as well as provide paid sick leave, paid family leave, and paid medical leave for home health workers and direct support professionals.
-
Support for People on Waiting Lists and Moving Back Home: Under Section 2(d)(2)(E) and Section 2(d)(2)(Q), states can provide services to individuals currently stuck on waiting lists and assist individuals who had to relocate to nursing facilities or institutions in moving back to their homes with one-time start-up costs and necessary mental health services.
-
Help for Family Caregivers: Under Section 2(d)(2)(I), family care providers can receive needed supplies, equipment, and services, which explicitly includes family caregiver pay and respite services.
Potential Negative Impacts for People
- Potential Administrative Burdens: While the text aims to expand care, Section 2(b) and Section 2(e) impose strict application, data validity, oversight, and reporting requirements on states, which could potentially slow down the actual delivery of care if bureaucratic hurdles delay state implementation and approvals.
