What this bill would do
The "Truth in Tariffs Act" aims to increase transparency regarding how certain tariffs affect the prices of goods sold to consumers. It requires sellers to clearly display the portion of a product's price that is due to a "covered tariff," which includes tariffs imposed by the President on an emergency or discretionary basis after January 20, 2025. This requirement does not apply to small business concerns. The Federal Trade Commission is tasked with creating regulations and enforcing these rules. Violations will be treated as unfair or deceptive acts or practices under the Federal Trade Commission Act.

Potential Positive Impacts for People
-
Increased Price Transparency: Under Section 2(a), consumers will be able to see the "tariff surcharge," which is the specific part of a price attributed to a covered tariff. This provides clarity on how much a tariff is contributing to the cost of a good.
-
Consumer Protection against Deception: Section 2(d)(1) treats violations of this Act as unfair or deceptive acts or practices. This allows the Federal Trade Commission to use its existing powers to protect people from misleading price displays.
Potential Negative Impacts for People
- Compliance Burdens for Non-Small Businesses: According to Section 2(a) and 2(b), any person selling goods to a consumer—excluding small business concerns—must implement a way to clearly and conspicuously display the tariff surcharge. This creates a specific requirement for larger sellers to track and display this information.
