What this bill would do
The LEO Fair Retirement Act of 2025 aims to amend title 5 of the United States Code regarding retirement for federal law enforcement officers. Currently, many officers work significant overtime that they are never compensated for due to pay caps. This bill would allow these officers to include that uncompensated premium pay in their retirement annuity calculations. To do this, officers must make a lump-sum payment to the Office of Personnel Management. The bill also extends availability pay eligibility to several specific roles, such as Postal Inspectors and Federal air marshals.

-
Increased Retirement Annuities: Federal law enforcement officers can include premium pay that was previously uncompensated in their annuity computations, allowing them to reclaim full credit in retirement (Section 2).

Recruitment and Retention: By allowing officers to reclaim credit for overtime hours worked but never paid, the government can better ensure it can recruit and retain high-s_caliber personnel (Section 1(b)(5)).
-
Expanded Pay Eligibility: Certain employees, including Postal Inspectors, Federal air marshals, and criminal investigators, will now be eligible for availability pay (Section 3(a)).
-
Tax Relief for Payments: Individuals who make the required lump-sum payments to adjust their retirement annuity are allowed a tax credit against the tax imposed by chapter 1 of the Internal Revenue Code of 1986 (Section 4(a)).
Potential Negative Impacts for People
-
Required Lump-Sum Payments: To receive the increased retirement annuity, an officer is required to make a lump-sum payment to the Office, which could be made from their Thrift Savings Fund account (Section 2(a)(1), Section 2(d)(2)).
-
Irrevocable Decisions: Once an officer elects to make the lump-sum payment, that election is considered irrevocable (Section 2(a)(1)(B)(ii)).
