What this bill would do
The "Responsibility in Drug Advertising Act of 2025" aims to amend the Federal Food, Drug, and Cosmetic Act. The bill seeks to restrict direct-to-consumer drug advertising, including on social media platforms. Under this proposal, drugs approved under section 505(c) would be prohibited from direct-to-consumer advertising for the first three years following approval. The Secretary has the authority to grant a waiver for this prohibition if advertising is deemed to have affirmative value to public health. Additionally, the Secretary can prohibit advertising after the initial three-year period if the drug is found to have significant adverse health effects.
