What this amendment would do
Mr. Blumenthal submitted SA 6821 to protect student athletes and promote fair competition in intercollegiate athletics. Looking out for the good of the people, we need to make sure our elected officials and state leaders have the tools to hold people accountable.
This amendment aims to add a new section called TITLE IV--ENFORCEMENT BY STATES to the bill. Specifically, it adds the following:
- If a State attorney general believes someone has violated the Act, its amendments, or regulations affecting state residents, the State can bring a civil action in a U.S. district court.
- The civil action can be used to stop further violations, force compliance, get remedies allowed under State law, and get damages, restitution, or compensation for State residents.
- The amendment states that nothing in the Act prevents a State's chief law enforcement officer, official, or agency from using their existing State powers to run investigations, administer oaths, or compel witnesses and evidence.
