What this amendment would do
Mrs. Moody submitted amendment SA 6808, which is intended to be proposed to another amendment for the bill S. 4668. The purpose of this amendment is to add a new section titled "NO PRIVATE EQUITY IN COLLEGE ATHLETICS" to the Sports Broadcasting Act of 1961.
Simply put, this amendment aims to stop private equity funds from getting involved in college sports money. It adds specific rules that block these funds from providing funding, resources, or financial incentives for several college athletics activities.
Here is what the amendment aims to prevent private equity funds from doing:
- Providing funding, resources, or financial incentives to entice a conference or institution to voluntarily pool media rights.
- Providing funding, resources, or financial incentives to merge or acquire a conference or institution, or to create a new conference or intercollegiate athletic association.
- Providing funding, resources, or financial incentives to an athletic department to make a financial agreement where the fund gets a return on investment or a share of the revenue.
If a private equity fund breaks any of these rules, the amendment makes them subject to the penalties described in section 217 of the Investment Advisers Act of 1940.
