What this amendment would do
SA 6676, submitted by Mr. Hagerty and Mr. Kaine, aims to change the conditions for vessels entering ports in the United States by amending Section 70022 of title 46, United States Code.
The amendment adds rules regarding vessels that, after fiscal year 2025, have operated in or entered a port, harbor, or marine terminal within specific geographic coordinates (2034'31'' N, 2034'13'' N, 8707'47'' W, 8707'20'' W). It targets ports that the President determines were owned, held, or controlled by a United States person at the time they were nationalized or expropriated by a foreign trade partner's government or official, and are not currently in arbitration under a free trade agreement with the United States.
The amendment allows for exceptions if:
- An individual or the vessel is experiencing an emergency.
- The United States person authorized the vessel to operate or enter the port, harbor, or marine terminal.
The restrictions cease to apply if the President determines that ownership and control have been restored to the United States person and nationalization measures have ended, or if the foreign government provides compensation equivalent to the full value of the property as required by international law, or if the President determines the matter is otherwise resolved.
For these purposes, a United States person is defined as a U.S. citizen, a lawful permanent resident, or an entity organized under U.S. laws, including its foreign branches.
