What this amendment would do
This amendment, submitted by Mr. Banks, aims to add a new section to bill S. 4784 regarding determinations for entities found on the Department of Defense Chinese Military Company List.
The purpose of this addition is to establish a process where the Commission (Federal Communications Commission) can annually request that an interagency body determine if communications equipment or services from specific entities pose unacceptable risks to United States national security or the safety and security of United States persons.
Key Changes and Requirements
-
Request Process: The Commission can ask an interagency body to make determinations about entities on the Department of Defense Chinese Military Company List, as well as their subsidiaries, affiliates, or joint venture partners.
-
Required Assessments: The interagency body must make a specific assessment within 180 days for the following entities (including their affiliates, subsidiaries, or joint venture partners):
- Hangzhou Yushu Technology Co., Ltd. (Unitree)
- BGI Group
- MGI Tech Co., Ltd.
- Quectel Wireless Solutions Co., Ltd.
- China Mobile Communications Group Co., Ltd.
- Contemporary Amperex Technology Co., Limited (CATL)
- BYD Co., Ltd.
- WuXi AppTec Co., Ltd.
- Yangtze Memory Technologies Co., Ltd. (YMTC)
- ChangXin Memory Technologies, Inc. (CXMT)
-
Review Criteria: When making these determinations, the interagency body must consider if the equipment or services:
- Can be used for surveillance, data collection, or unauthorized access to networks of the United States or its allies.
- Contain hardware vulnerabilities, malicious code, or backdoors for exploitation by a foreign adversary.
- Are subject to People's Republic of China laws or policies that could force them to help Chinese security or intelligence services.
- Pose any other unacceptable risk to United States national security or the safety of its persons.
-
Outcome of Determinations: The interagency body must send the determination to the Commission and report the results to the appropriate congressional committees. If a risk is found, the Commission must add those services or equipment to the list published under the Secure and Trusted Communications Networks Act of 2019.
