What this amendment would do

This amendment, submitted by Ms. Slotkin and Ms. Ernst, aims to change how certain actions taken by the Secretary of Defense under the Defense Production Act of 1950 are handled regarding federal permitting.

Purpose and Changes

The amendment proposes to treat specific actions as a covered project under the FAST Act and include them in the Permitting Dashboard. These actions involve the Secretary of Defense using specific presidential determinations or memorandums to create, protect, expand, or restore domestic production capabilities through:

  • Supporting feasibility studies for mature mining, beneficiation, and value-added processing projects.
  • Byproduct and co-product production at industrial facilities, mine waste reclamation, and existing mining.
  • Modernizing value-added processing, beneficiation, and mining to improve workforce safety, environmental sustainability, and productivity.
  • Any other activity authorized under section 303(a)(1) of the Defense Production Act of 1950.

Exception

An action will not be treated as a covered project or included in the Permitting Dashboard if the project sponsor requests that it not be treated as such.
