What this amendment would do
SA 6302, submitted by Mr. HUSTED, aims to add a new section to bill S. 4784. The purpose is to require the Secretary of Defense to create a report on how the domestic supply and use of critical chemicals used in petroleum refining and related industrial processes affect national security.
Report Requirements
The amendment requires the report to be submitted to the Committees on Armed Services of the Senate and the House within 180 days of the Act's enactment. The report must include:
- An assessment of domestic production capacity and supply chains, including dependencies on foreign sources or single-supplier vulnerabilities.
- An evaluation of how these chemicals support the defense industrial base, including the production of materials and fuels for military operations.
- An analysis of how military fuel requirements rely on these chemicals and the potential impacts if they were constrained.
- An assessment of risks to infrastructure and supply chains, such as cyber threats and physical security.
- Recommendations for the Department of Defense and other Federal agencies to mitigate risks, such as diversification of sources or strategic stockpiling.
Protections and Format
Information from private sector entities will be treated as protected critical infrastructure information and is exempt from Freedom of Information Act disclosure.
The report must be submitted in unclassified form with a classified annex. The unclassified part will focus on policy recommendations and strategic risks. The classified annex will contain:
- Site-specific vulnerability assessments.
- Granular production capacities of individual refineries.
- Detailed transportation route mappings for hazardous chemicals.
