What this amendment would do
Amendment SA 6276, submitted by Mr. Kaine, aims to change the War Powers Resolution.
Changes and Additions:
-
Defining Hostilities: It adds a rule stating that "United States Armed Forces are introduced into hostilities" includes any use of lethal or potentially lethal force by or against those forces. This applies regardless of if it is self-defense, the domain used, or if the attacks are directed, piloted, or remotely launched.
-
Updating Timelines: It changes the timelines for the removal of United States Armed Forces. It replaces "sixty calendar days" with "ten calendar days" and changes the extension period from "not more than an additional thirty days" to "not more than an additional ten days."
-
Legal Reporting: It adds a requirement to provide any legal opinion, memorandum, or analysis from the Executive Branch—including the White House, National Security Council, or Department of Justice—regarding the introduction of United States Armed Forces.
