What this amendment would do
This amendment, submitted by Mr. Schatz and Mr. Curtis, aims to add a section on AI Labeling to the bill. Its purpose is to ensure transparency by requiring that artificial intelligence-generated content be clearly identified.
Key Changes and Additions:
-
Requirements for AI Providers: Providers of generative AI systems must label "covered AI-generated content" with a clear disclosure. This includes embedding a machine-readable disclosure that identifies the system version, the date and time of creation, and other relevant info. They must also ensure this content is detectable by users or online platforms.
-
Requirements for Online Platforms: Large "covered online platforms" must clearly identify AI-generated content that has a machine-readable disclosure and are prohibited from removing or tampering with those disclosures.
-
Chatbot Disclosure: Anyone providing an AI chatbot must include a clear disclosure identifying it as such.
-
Prohibitions and Protections: The amendment bans the fraudulent falsification of disclosures, the distribution of content to deceive others about its origin for financial gain, and the creation of tools specifically designed to remove or tamper with these labels.
-
Enforcement: The Federal Trade Commission (FTC) is tasked with enforcing labeling requirements. The Attorney General of the United States, state attorneys general, and harmed private parties can bring civil actions against those who fraudulently tamper with or remove disclosures.
-
Working Group: It establishes an AI-generated content consumer transparency working group led by the Director of the National Institute of Standards and Technology to create technical standards and guidelines for labeling and detection.
