What this amendment would do

This amendment, proposed by Mr. Schatz, adds two new titles to bill S. 4784. The purpose is to restrict children's and teens' access to social media and limit how social media platforms use their data, while also restricting social media access in schools.

Kids Off Social Media Act

This part of the amendment aims to change how social media platforms interact with minors:

  • Children under 13: Platforms cannot allow children under 13 to create or keep accounts. If a platform knows a user is a child, it must terminate the account and delete their personal data.
  • Personalized Recommendations: Platforms are prohibited from using personal data to show content to children or teens via personalized recommendation systems, with limited exceptions for basic data like device type, language, and location.
  • Enforcement: The Federal Trade Commission (FTC) and State attorneys general are authorized to enforce these rules.

Eyes on the Board Act of 2026

This part of the amendment updates the Children's Internet Protection Act to target social media in educational settings:

  • School Requirements: Elementary and secondary schools must certify that they prevent students from accessing social media platforms on supported devices and networks.
  • Technology Measures: Schools must use technology protection measures to block social media access to remain eligible for certain broadband subsidies.
  • Transparency: The FCC will create a public database containing the internet safety policies submitted by schools.
