What this amendment would do

SA 6114, submitted by Mr. Husted, aims to add a new section to bill S. 4784 titled "Analysis of Threats Posed by Foreign Adversary Access to Controlled Items Within the United States."

The purpose of this amendment is to require the Under Secretary of the Bureau of Industry and Security of the Department of Commerce, acting through the Executive Director of the Office of Information and Communications Technology and Services (OICTS), to complete a review and report on the following:

  • Whether U.S.-domiciled affiliates (owned 50 percent or more by entities on the Entity List or Military End User List) can get items that their parent companies are restricted from accessing due to U.S. export controls.
  • The impact on the effectiveness of U.S. export controls if those affiliates can acquire such items.
  • Risks to national security or export control effectiveness caused by foreign-adversary controlled information and communications technology and services (ICTS).
  • Whether specific sectors of foreign-adversary controlled ICTS create undue risk.
  • The steps the Under Secretary and Executive Director plan to take within the next year to address these threats.
  • Any recommended changes to U.S. law to help address the threats.

The review must be completed within 90 days of the Act's enactment, and the results must be reported to the House Committee on Foreign Affairs and the Senate Committee on Banking, House, and Urban Affairs within 30 days after the review is finished.
