What this amendment would do
This amendment aims to change the Defense Production Act of 1950 to give the Committee on Foreign Investment in the United States (CFIUS) more power to review and block certain agricultural transactions.
The purpose is to stop covered foreign persons—specifically those from the People's Republic of China, the Russian Federation, the Islamic Republic of Iran, and the Democratic People's Republic of Korea—from buying or leasing agricultural land near sensitive U.S. military installations or government facilities. It also targets foreign control of U.S. businesses engaged in agriculture.
Key changes include:
- Adding the Secretary of Agriculture to the committee for transactions involving agricultural land, biotechnology, or the agriculture industry.
- Creating a review process where the Committee determines if a reportable agricultural land transaction is a "covered transaction" after being notified by the Secretary of Agriculture.
- Granting the President the power to prohibit these transactions, though the President can waive this requirement if it is in the national interest of the United States.
- Requiring spending plans from each department or agency on the Committee to be submitted to the chairperson within 60 days of the Act's enactment.
- Setting a timeline for the President to issue regulations to carry out these changes within 18 months.
