What this amendment would do
SA 6093, submitted by Mr. Kaine, aims to add a section to bill S. 4784 that prohibits the use of Department of Defense funds to deploy, station, maintain, or support the United States Armed Forces in the territory, airspace, or territorial waters of Iran.
This prohibition would apply unless there is a specific statutory authorization enacted after the Act or a congressional authorization consistent with section 2(c) of the War Powers Resolution.
The amendment includes specific exceptions where the United States can still:
- Defend against armed attacks on the United States, its personnel, or facilities in other nations.
- Collect, analyze, or share intelligence regarding threats from Iran or its proxies with other nations, international organizations, and the State of Israel.
- Assist the State of Israel and other nations by providing defensive materiel support or helping them take defensive measures to protect their territory from retaliatory attacks by Iran or its proxies.
This section does not supersede the War Powers Resolution and the prohibition would terminate 5 years after the Act is enacted.
