What this amendment would do
SA 6092, submitted by Mr. Kaine, aims to change the Arms Export Control Act by adding a section regarding the pre-approval for the sale of defense articles to Taiwan.
The purpose of this amendment is to allow the approval of defense article sales to the Government of Taiwan without applying subsections (a), (b), and (d) of Section 3, provided that:
- The Government of Taiwan gives a written commitment to the U.S. Government, the Senate Committee on Foreign Relations, and the House Committee on Foreign Affairs that it will not transfer the articles to any other person or foreign country without the President's consent, unless they are demilitarized.
- The sale matches specific RSAT case numbers as of January 15, 2026: 26-AD, 26-AO, 26-AQ, or 26-AN.
Additionally, the amendment requires the President to notify the Speaker of the House and the relevant Senate and House committees within 72 hours after such a sale is completed.
The amendment also clarifies that it does not limit the timing, quantity, or type of defense articles requested or transferred, and that any requests to retransfer these articles remain subject to the relevant provisions of the Act.
