What this amendment would do
The amendment, known as the Respect for Local Communities Act, aims to add new requirements to bill S. 4784 regarding the creation of new processing sites or detention centers for U.S. Immigration and Customs Enforcement (ICE).
The purpose of this amendment is to prevent the Department of Homeland Security or other Federal agencies from starting the construction, acquisition, renovation, or operation of these facilities until several conditions are met:
-
The agency must provide a public notice in the Federal Register for at least 30 days for public comments, including the scope of the project, due diligence on environmental and detention standards, other relevant documentation, and an engineering review and economic impact analysis regarding electrical demand, water usage, and waste exportation.
-
The head of the Federal agency must respond to significant public comments and sign a written agreement with the Governor of the State and appropriate local government officials (such as the mayor, county executive, or a majority of the local legislative authority).
-
The agency head must submit a report including the signed agreement to specific House and Senate committees, and 30 days must pass after that submission.
