What this amendment would do

SA 6072, submitted by Mr. Hagerty and Mr. Kaine, aims to change the rules for vessels entering ports in the United States by amending Section 70022 of title 46, United States Code.

The amendment adds conditions for entry into U.S. ports based on the following:

  • It addresses vessels that, after fiscal year 2025, have operated in or entered a port, harbor, or marine terminal within specific geographic coordinates (2034'31'' N, 2034'13'' N, 8707'47'' W, 8707'20'' W).

  • This applies if that location was owned, held, or controlled by a United States person at the time it was nationalized or expropriated by a foreign trade partner's government, or if actions were taken that had the same effect.

  • A United States person is defined as a U.S. citizen, a lawful permanent resident, or an entity organized under U.S. laws, including its foreign branches.

The amendment also specifies when these restrictions stop applying:

  • If the President determines ownership or control has been restored to the U.S. person and the foreign government has ended the nationalization or expropriation measures.

  • If the President determines the foreign government provided compensation that is mutually acceptable and equivalent to the full value of the property as required by international law.

Finally, the amendment adds exceptions for vessels experiencing an emergency or those authorized by the affected U.S. person to enter the port, harbor, or marine terminal.
