What this amendment would do

SA 6046, submitted by Mr. PADILLA, aims to add a new section to the bill to create an interest-bearing account for non-federal contributions to the Lower Colorado River Multi-Species Conservation Program.

The amendment proposes the following changes and additions:

  • Establishment of a Fund: It creates the Non-Federal Funding Account for the Lower Colorado River Multi-Species Conservation Program within the Treasury of the United States.

  • Funding Sources: The fund will consist of non-federal contributions from State Parties (both those provided before and after the enactment date) and any interest earned on investments.

  • Spending Rules:

    • Deposited contributions can be spent by the Secretary without further appropriation.
    • Interest earned on those amounts is subject to appropriation before the Secretary can spend it.

  • Investment and Transfers:

    • The Secretary of the Treasury can invest fund portions not currently needed, but only in interest-bearing obligations of the United States.
    • Previously contributed funds must be transferred from the general fund of the Treasury within 90 days of enactment.

  • State Party Protection: State Parties will not be held responsible for any losses resulting from the investment of these amounts.
