What this amendment would do

SA 5870, submitted by Mr. DAINES, aims to add a new section to S. 4784. This addition requires the Director of the Defense Logistics Agency to provide advance notification to congressional defense committees regarding the use of proprietary labels.

Specifically, the amendment changes the process by requiring notification before:

  • Procuring a new item with a national stock number originally listed as proprietary, including a justification and a price comparison to a non-proprietary similar item.

  • Updating the characteristics data of a national stock number to proprietary, including a justification, a price comparison to a non-proprietary similar item, and the change in cost per unit.

Additionally, the amendment requires the Director to submit a report to Congress at least once a year detailing the year-over-year use of proprietary labels by the Department of Defense and the resulting price increases.
