What this amendment would do
SA 5760, submitted by Mr. Padilla, is an amendment to SA 5453 regarding bill S. 2. Its purpose is to add a Rule of Construction to the act.
The amendment aims to ensure that nothing in the Act or any other Act limits the ability of state and local governments to oversee U.S. Immigrations and Customs Enforcement and U.S. Customs and Border Protection.
Specifically, it seeks to protect the ability of these jurisdictions to:
-
Investigate and prosecute potential crimes and use-of-excessive-force incidents.
-
Require evidence to be preserved and shared with those jurisdictions.
-
Require prior consent to conduct large-scale operations that are outside of targeted immigration enforcement.
