What this amendment would do

SA 5435, submitted by Mr. HEINRICH, aims to add a deficit-neutral reserve fund to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for legislation focused on expediting the adjudication of immigration cases.

Specific actions that may be included under this purpose are:

  • Hiring additional immigration judges.
  • Rehiring immigration judges who were recently dismissed.
  • Retaining immigration judges unless there is good cause for their removal.

This is provided that the legislation does not increase the deficit from fiscal year 2026 through 2035.
