What this amendment would do
SA 5385, submitted by Ms. Smith, aims to add a section to title III of S. Con. Res. 33. This section creates a deficit-neutral reserve fund focused on protecting the rights of lawfully admitted refugees.
The purpose of this amendment is to allow the Chairman of the Senate Committee on the Budget to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation related to protecting the rights of lawfully admitted refugees.
This legislation may include the following:
- Prohibiting policies or programs that re-vet lawfully admitted refugees based on national origin, ethnicity, or race without individualized suspicion.
- Prohibiting the indefinite and mandatory detention of lawfully admitted refugees.
- Prohibiting the stripping of legal status from lawfully admitted refugees without a particularized basis.
This is permitted as long as the legislation does not increase the deficit from fiscal year 2026 through 2035.
