What this amendment would do
SA 5379, submitted by Mr. Welch, is an amendment to S. Con. Res. 33, which sets the congressional budget for fiscal year 2026 and budgetary levels for fiscal years 2027 through 2035.
The purpose of this amendment is to create a deficit-neutral reserve fund to redirect and rescind specific funds from the One Big Beautiful Bill Act (Public Law 119-21).
The amendment aims to change the following:
- It seeks to ensure Blockbuster orphan drugs are not exempt from Medicare drug price negotiation.
- This may include repealing section 71203 of the Act to allow Medicare to negotiate prices for rare disease drugs if annual Medicare spending on a drug exceeds $400,000,000, regardless of orphan status.
- The repeal would be paid for by rescinding funds from sections 90003 and 100052 of the Act, which includes funds for the Department of Homeland Security, Immigration and Customs Enforcement, or Customs and Border Patrol.
- The legislation must not increase the deficit from fiscal years 2026 through 2035.
