What this amendment would do

SA 5372, submitted by Mr. Merkley, aims to add a deficit-neutral reserve fund to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation focused on sensible reforms to Federal immigration agencies.

The amendment specifies that these reforms may include:

  • Prohibiting Department of Homeland Security officers and agents from entering private property without a judicial warrant.
  • Prohibiting U.S. Immigration and Customs Enforcement officers and agents from wearing masks or not wearing operational body cameras.
  • Requiring Federal officers to show identification during immigration enforcement.
  • Enforcing the current ban on Federal immigration enforcement operations at polling places.
  • Prohibiting Federal immigration enforcement at sensitive locations.
  • Prohibiting racial profiling during Federal immigration enforcement stops.
  • Requiring training and reasonable use of force policies for Federal immigration officers.
  • Preserving the power of State and local jurisdictions to prosecute potential crimes and excessive force incidents involving Federal immigration officers.

This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
