What this amendment would do

SA 5356, submitted by Mr. Bennet, aims to add a section to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund regarding the prohibition of using funds for the detention of pregnant or lactating women.

This change would allow the Chairman of the Committee on the Budget of the Senate to:

  • Revise committee allocations, aggregates, and other levels in the resolution.
  • Make adjustments to the pay-as-you-go ledger for specific legislative actions.

These actions apply to legislation relating to prohibiting the detention of pregnant or lactating women, which may include:

  • Ensuring access to prenatal or appropriate medical care.
  • Expanding community-based supervision programs.

This is provided that the legislation does not increase the deficit from fiscal year 2026 through 2035.
