What this amendment would do

SA 5351, submitted by Ms. BLUNT ROCHESTER, aims to add a section to title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to preserve free appropriate public education for children with disabilities.

It allows the Chairman of the Committee on the Budget of the Senate to make the following changes:

  • Revise allocations, aggregates, and other levels in the resolution.
  • Make adjustments to the pay-as-you-go ledger for specific legislative items.

The amendment specifies that this may include:

  • Redirecting funds from U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.
  • Increasing funding for the Individuals with Disabilities Education Act.
  • Preventing the illegal transfer of programs authorized under the Individuals with Disabilities Education Act from the Department of Education.

This is provided that the legislation does not increase the deficit between fiscal years 2026 through 2035.
