What this amendment would do
SA 5311, submitted by Mr. DURBIN, aims to add a section to the end of title III of S. Con. Res. 33. This resolution sets the congressional budget for fiscal year 2026 and budgetary levels for fiscal years 2027 through 2035.
The purpose of this amendment is to create a deficit-neutral reserve fund regarding locations where immigration enforcement may occur. It allows the Chairman of the Committee on the Budget of the Senate to:
- Revise committee allocations, aggregates, and other appropriate levels.
- Make adjustments to the pay-as-you-go ledger for specific items like bills reported by the Committee on the Judiciary of the Senate, amendments, motions, or conference reports.
The amendment specifies that these actions relate to locations where immigration enforcement may occur. This can include prohibiting enforcement near sensitive locations, such as:
- Hospitals
- Schools
- Houses of worship
- Locations providing safe harbor for survivors of domestic violence
This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
