What this amendment would do

SA 5306, submitted by Ms. Duckworth, aims to add a section to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund. This would allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation that provides citizens with a private cause of action.

This private cause of action is intended for citizens who were wrongfully arrested or detained during the following:

  • Operation Midway Blitz
  • Operation Charlotte's Web
  • Operation Metro Surge
  • Similar operations

The aim is to allow these citizens to seek injunctive relief and statutory damages of $500,000, provided the legislation does not increase the deficit between fiscal years 2026 through 2035.
