What this amendment would do

SA 5304, submitted by Ms. Duckworth, aims to add a section to title III of the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund. This fund would allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for legislation that does the following:

  • Requires the Secretary of Homeland Security to determine if an alien is serving or has served in the Armed Forces during immigration benefit applications or enforcement proceedings.
  • Requires immigration and naturalization records to be annotated to show this service and track case outcomes.
  • Prohibits using the information gathered for these purposes to remove those individuals from the United States.

This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
