What this amendment would do

SA 5258, submitted by Mr. KIM, aims to add a new section to S. Con. Res. 33. The purpose is to create a point of order that would block federal funding for U.S. Immigration and Customs Enforcement or U.S. Customs and Border Protection through budget reconciliation if an employee of either agency killed, arrested, detained, or held a United States citizen in custody during the most recent fiscal year.

  • The amendment adds Section 4109, which prevents the Senate from considering certain bills, joint resolutions, or amendments that provide this funding under the stated conditions.

  • This restriction can only be waived, suspended, or used to sustain an appeal of the Chair's ruling with an affirmative vote of three-fifths of the Members of the Senate.
