What this amendment would do

SA 5246, submitted by Ms. Duckworth and Mr. Blumenthal, aims to add a deficit-neutral reserve fund to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to protect veterans from being unnecessarily or wrongfully placed in conservatorships or legal guardianships. It allows the Senate Budget Committee Chairman to adjust budget allocations and the pay-as-you-go ledger for legislation that focuses on:

  • Ensuring the memorandum of understanding between the Department of Veterans Affairs and the Department of Justice requires independent psychological or medical evaluations to determine a veteran's incapacity.
  • Ensuring due process protections, such as the right to counsel, notice, and the ability to contest guardianship or conservatorship determinations.
  • Ensuring other ethical safeguards are in place.

This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
