What this amendment would do

SA 5235, proposed by Mr. Merkley, aims to add a section to the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund regarding the impacts of hedge fund ownership of single-family homes and rent prices.

The amendment seeks to allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for legislation reported by the Committee on the Judiciary of the Senate. This legislation would relate to Department of Justice antitrust enforcement to help American families, which may include:

  • Reducing the single-family housing market share of large single-family housing investors.
  • Addressing how these investors affect home ownership, housing availability, housing affordability, gentrification, home maintenance, and eviction rates.
  • Deeming the acquisition of single-family homes by large institutional investors as contracts in restraint of trade.

This is provided that the legislation does not increase the deficit between fiscal years 2026 through 2035.
