What this amendment would do
SA 5204, submitted by Ms. Cantwell, aims to add a section to title III of S. Con. Res. 33.
The purpose of this amendment is to create a deficit-neutral reserve fund focused on lowering prescription drug prices.
It would allow the Chairman of the Committee on the Budget of the Senate to adjust budget allocations and the pay-as-you-go ledger for legislation that lowers drug prices by stopping pharmacy benefit managers from using practices that raise costs. These practices may include:
- Spread pricing
- Claw backs
- Offsets
This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
