What this amendment would do

SA 5196, submitted by Mr. Merkley and Mr. Ossoff, aims to add a section to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund. This allows the Senate Budget Committee Chairman to adjust budget allocations and the pay-as-you-go ledger for legislation that focuses on:

  • Prohibiting Members of Congress, their spouses, and dependent children from trading and holding the following:
    • Stocks
    • Non-diversified mutual funds
    • Exchange traded funds
    • Commodities
    • Futures
    • Event contracts
    • Digital assets

The amendment also notes that such legislation may include the establishment of penalties for noncompliance, provided the legislation does not increase the deficit from fiscal years 2026 through 2035.
