What this amendment would do
SA 5195, submitted by Mr. Merkley, aims to add a deficit-neutral reserve fund to S. Con. Res. 33, which is the congressional budget for fiscal year 2026 and the budgetary levels for fiscal years 2027 through 2035.
The purpose of this amendment is to allow the Chairman of the Senate Committee on the Budget to adjust budget allocations and the pay-as-you-go ledger for legislation focused on holding U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection officers and agents accountable.
Specifically, this may include legislation that allows victims to sue the Federal Government if agents or officers from these agencies violate Federal law by abridging constitutional rights, including:
- Free speech
- Unreasonable search and seizure
- Due process
This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
