What this amendment would do
SA 5109, submitted by Ms. BLUNT ROCHESTER, aims to add a section to title III of S. Con. Res. 33.
The purpose of this amendment is to create a deficit-neutral reserve fund to preserve free appropriate public education for children with disabilities.
It would allow the Chairman of the Committee on the Budget of the Senate to make adjustments to the pay-as-you-go ledger and revise budgetary levels for legislation that:
- Increases funding for the Individuals with Disabilities Act.
- Preserves free appropriate public education for children with disabilities.
- Prevents the illegal transfer of programs authorized under the Individuals with Disabilities Education Act from the Department of Education.
This may include redirecting funds from U.S. Customs and Border Protection and U.S. Immigration and Customs Enforcement.
The amendment specifies that such legislation must not increase the deficit for the total of fiscal years 2026 through 2035.
