SA 5107, submitted by Mr. Durbin, is an amendment to the concurrent resolution S. Con. Res. 33. Its purpose is to create a deficit-neutral reserve fund to help prevent cryptocurrency ATM fraud.
The amendment aims to add a section that allows the Chairman of the Committee on the Budget of the Senate to adjust budgetary levels and the pay-as-you-go ledger for legislation that focuses on the following:
- Requiring virtual currency kiosk operators to register with the Financial Crimes Enforcement Network of the Department of Treasury.
- Providing fraud warnings and disclosures on all virtual currency kiosks.
- Requiring consumer acknowledgement of disclosures on all virtual currency kiosks.
- Appointing a compliance officer.
- Providing print receipts at all virtual currency kiosks.
- Using blockchain analytics.
- Refunding fees for existing customers and full transactions for new customers regarding fraudulently induced transactions.
- Imposing daily transaction limits of $1,000 for new customers and $2,000 for existing customers.
- Providing live customer service.
