What this amendment would do
SA 5106, submitted by Mr. Durbin, aims to add a section to the concurrent resolution S. Con. Res. 33.
The purpose of this amendment is to create a deficit-neutral reserve fund to prohibit taxpayer-funded bailouts for the digital asset industry.
Specifically, it allows the Chairman of the Committee on the Budget of the Senate to adjust budget levels and the pay-as-you-go ledger for legislation that prevents the following from receiving Federal agency financial assistance, emergency liquidity facility access under section 13(3) of the Federal Reserve Act, or Exchange Stabilization Fund access to prevent failure or bankruptcy:
- Digital asset intermediaries
- Digital asset service providers
- Distributed ledger protocols
- Decentralized finance trading protocols
- Digital asset commodity intermediaries
- Financial service providers regarding digital asset activities
This is provided that the legislation does not increase the deficit between fiscal years 2026 and 2035.
