What this amendment would do

SA 5080, submitted by Mr. Lujan, aims to add a section to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to ensure federal agencies have enough staff to meet their government-to-government consultation obligations with Tribal Nations during environmental review and permitting processes.

The amendment allows the Chairman of the Senate Committee on the Budget to adjust budget levels and the pay-as-you-go ledger for legislation that supports dedicated Tribal liaison and consultation staffing at agencies such as:

  • The Environmental Protection Agency
  • The Corps of Engineers
  • The Bureau of Land Management
  • The Forest Service

The goal is to prevent staffing reductions or resource constraints from compromising obligations under executive trust responsibility requirements, the National Environmental Policy Act of 1969, and section 306108 of title 54, United States Code. Priority is to be given to agencies with active permitting dockets in regions with significant cultural resource interests and Tribal land.

This is provided that the legislation does not increase the deficit from fiscal year 2026 through 2035.
