What this amendment would do

SA 5006, submitted by Mr. Bennet, aims to add a section to title III of S. Con. Res. 33.

The purpose is to create a deficit-neutral reserve fund. This fund relates to preventing actions that would block the scheduled retirement of electric generators when continuing to operate them would increase electricity costs for ratepayers.

The amendment allows the Chairman of the Committee on the Budget of the Senate to adjust budgetary levels and the pay-as-you-go ledger for legislation pursuing this goal, provided that:

  • The legislation does not increase the deficit between fiscal years 2026 through 2035.
  • It does not apply if a grid operator has formally found through the Federal Energy Regulatory Commission that continued operation is needed for a specific and acute reliability risk that cannot be solved by lower-cost alternatives.
