What this amendment would do

SA 4944, submitted by Mr. Van Hollen, aims to add a new section to title IV of the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a point of order in the Senate against funding contracts for:

  • Private prisons that are not subject to the Freedom of Information Act.
  • Warehouse detention centers that are not subject to the Freedom of Information Act.

This means the Senate would not be allowed to consider any motion, amendment, bill, joint resolution, or conference report that funds these specific entities unless the restriction is waived.

To waive or suspend this rule, or to sustain an appeal of the Chair's ruling on this point of order, an affirmative vote of three-fifths of the Members of the Senate is required.
