What this amendment would do

SA 4830, submitted by Mr. KIM, aims to add Section 3003 to the end of title III of S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund that allows the Chairman of the Committee on the Budget of the Senate to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation related to supporting immigration judge orders.

Specifically, the amendment mentions that this may include legislation that:

  • Prohibits the Department of Homeland Security from using discretionary stays pending custody by U.S. Immigration and Customs Enforcement.
  • Prohibits U.S. Immigration and Customs Enforcement from defying judicial bond determinations.

This is provided that the legislation does not increase the deficit between fiscal years 2026 through 2035.
