What this amendment would do

SA 4829, submitted by Mr. Kim, aims to add Section 3003 to title III of the concurrent resolution S. Con. Res. 33.

The purpose of this amendment is to create a deficit-neutral reserve fund to help ensure immigration courts have adequate staffing and to retain qualified immigration judges.

It seeks to achieve this by allowing the Chairman of the Senate Committee on the Budget to adjust budget allocations and the pay-as-you-go ledger for legislation that improves staffing by:

  • Prohibiting the unjustified removal of permanent or probationary immigration judges without cause or due to their political views.
  • Prohibiting court closures or consolidations.

This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
