What this amendment would do
SA 4806, submitted by Mr. Hickenlooper, is an amendment to S. Con. Res. 33. This resolution sets the congressional budget for fiscal year 2026 and the budgetary levels for fiscal years 2027 through 2035.
The purpose of this amendment is to create a deficit-neutral reserve fund. This allows the Chairman of the Senate Committee on the Budget to adjust budget allocations, aggregates, and the pay-as-you-go ledger for legislation that aims to:
- Prohibit Department of Homeland Security officers, specifically those from U.S. Immigration and Customs Enforcement and U.S. Customs and Border Protection, from performing immigration enforcement actions authorized under section 287 of the Immigration and Nationality Act without a judicial warrant from a Federal district court or magistrate judge.
This is permitted as long as the legislation does not increase the deficit between fiscal years 2026 and 2035.
