What this amendment would do
SA 4692, submitted by Mr. Kaine, aims to add a section to bill S. 1383 regarding the exemption of coffee, tea, cocoa, and similar items from certain duties.
The amendment proposes the following changes:
-
Duty Exemptions: It states that any duty imposed under section 122 or 301 of the Trade Act of 1974 on or after February 20, 2026, will not apply to articles classified under chapter 9 or 18 of the Harmonized Tariff Schedule of the United States.
-
Refunds: The Commissioner of U.S. Customs and Border Protection must refund duties paid on these articles, with interest, within 180 days after the Act is enacted. This includes the authority to reliquidate entries that were liquidated before the Act's enactment to provide these refunds.
-
Termination: The exemption will end 2 years after the date the Act is enacted.
-
Definition: The term "entry" is defined to include a withdrawal from warehouse for consumption.
