What this amendment would do
SA 4461, submitted by Mr. Kaine, aims to add a section to bill S. 1383 that prohibits the use of funds for the Department of Defense or any other government department or agency to deploy, station, maintain, or support the United States Armed Forces in the territorial waters, airspace, or territory of Iran.
This prohibition would end 5 years after the Act is enacted, unless the action is taken based on a congressional authorization consistent with section 2(c) of the War Powers Resolution or a specific statutory authorization enacted after this Act.
The amendment includes exceptions that allow the United States to:
- Defend against armed attacks on the United States, its facilities, or its personnel in other nations.
- Collect, share, or analyze intelligence regarding threats from Iran or its proxies, including with international organizations, other nations, and the State of Israel.
- Provide defensive materiel support or assist other nations and the State of Israel in taking defensive measures to protect their territory from retaliatory attacks by Iran or its proxies.
Additionally, this section does not supersede any requirements of the War Powers Resolution.
