What this amendment would do
The purpose of SA 4299 is to change Section 1979 of the Revised Statutes of the United States (42 U.S.C. 1983). It aims to add the following to the bill:
-
Public Employer Definition: It defines a public employer as a Federal law enforcement agency that employs or contracts with individuals empowered to make arrests, seize evidence, or execute searches.
-
Liability for Federal Agencies: It makes the United States or any State liable for the conduct of an officer who, while acting under color of law, deprives a person of rights, privileges, or immunities secured by laws and the Constitution.
-
Accountability Standards: The public employer is held liable regardless of whether the officer has immunity from suit or if a custom or policy of the employer caused the violation.
-
Sovereign Immunity: The amendment acts as a waiver of sovereign immunity for the United States regarding Federal law enforcement agencies for claims brought under this section.
-
Individual Officer Remedies: The changes do not limit or preclude any other legal or equitable remedies available against an individual officer.
